Confined Spaces in Construction

Unlike most general industry settings, construction worksites are dynamic and constantly changing, meaning the number, type, and characteristics of confined spaces evolve as work progresses. These environments often involve multiple employers, contractors, and controlling contractors, which increases the complexity of ensuring confined space safety.

Excluded Construction Activities

The following construction activities are regulated under separate OSHA standards and are not covered by Subpart AA:

  • Diving – 29 CFR Part 1926 Subpart Y
  • Excavations – 29 CFR Part 1926 Subpart P
  • Underground Construction, Caissons, Cofferdams, and Compressed Air – 29 CFR Part 1926 Subpart S

Competent Person Responsibilities

Before any work begins, each employer must ensure that a competent person:

  • Identifies all confined spaces in which employees may work.
  • Determines which spaces require a permit, through evaluation and testing of atmospheric and physical hazards as necessary.
